The state of Vermont plans to tell a federal appeals court on Wednesday that the Nuclear Regulatory Commission acted improperly last year when it granted a 20-year license extension to Entergy Corp.'s Vermont Yankee nuclear plant because the plant did not have an updated water quality certificate.

The tallest feature at the Entergy Corp.'s Indian Point nuclear power station in the New York suburbs is being torn down, but not all the way. A spokesman for plant owner Entergy Nuclear says workers will shorten an old ventilation stack by about 221 feet this summer. It currently rises about 255 feet above its building and 400 feet above sea level.
