] said Wednesday it has filed a complaint against rival Qualcomm Inc. [QCOM

], saying the company's sales and licensing practices amount to "patent misuse."
Irvine, CA-based Broadcom's lawsuit, filed Tuesday in the U.S. District Court for the Southern District of California in San Diego, also claims that Qualcomm's patents and patent licenses are "unenforceable" under applicable U.S. law.
A representative for San Diego-based Qualcomm could not immediately be reached for comment Wednesday morning. The companies have been embroiled in a series of patent lawsuits. Last month, an appeals court upheld a May 2007 jury verdict that Qualcomm violated two of Broadcom's patents. A third patent, however, was found to be invalid.
Broadcom said Qualcomm's practices "constitute patent misuse that has brought Qualcomm a financial windfall and brought harm to the industry and consumers."
