Pa. ice cream maker fined for clean-air violation

HARRISBURG, Pa. - A Pennsylvania ice cream maker has pleaded guilty to violating the federal Clean Air Act .

The Hershey Creamery Co. was fined $100,000 for failing to implement a plan for safely storing and using a hazardous substance used in refrigeration.

U.S. Attorney Martin Carlson said Friday the company admitted that it didn't have a plan for storing and handling anhydrous ammonia at its plants in Middletown and Harrisburg between Sept. 30, 2004 and April 2007.

Anhydrous ammonia is flammable and can irritate the skin and eyes.

Company attorney Matthew Gover says the creamery corrected the violations last year and has plans in place to make sure the problem doesn't recur.

The company is not affiliated with The Hershey Co., the nation's second-largest candymaker.
