State wants Superferry bankruptcy case moved

HONOLULU - The state wants the bankruptcy case of Hawaii Superferry transferred from Delaware, where it was filed on May 30, to a court in Hawaii.

The state contends Hawaii Superferry has no connection with Delaware aside from being incorporated there. It says all the company's operations were in Hawaii.

The state says it is too difficult to protect its interests when the case is being adjudicated nearly 5,000 thousand miles and six time zones away.

A hearing on the motion to move the case is set for July 1.

The Superferry was shut down in March after a decision by the Hawaii Supreme Court. The court ruled that a state law allowing the company to operate while an environmental study was being conducted was unconstitutional.
