Brawl on The Mall?

Are stocks stuck in a rut range bound because investors are worried about the outcome of mid-term elections?

That’s the growing chatter on the Street with many investors hoping Republicans can wrest 39 seats from the Dems and resume control of the House.

The Street’s current Republican bias is two part; 1) Republicans are presumed to be the party that’s friendlier to business and 2) it’s but because investors prefer gridlock in Congress. (Dems are unlikely to lose control of the Senate.)

Typically the incumbent party struggles during mid-term elections (that’s the Dems) and a lot of data suggests that’s going to be the case again this year. For example, according to Intrade, chances of Republicans winning the House have reached 75% probability.

However, Republicans might not want to count their chickens just yet.

House of Representative control has been an elusive task for the Republican Party. Prior to the landslide victory led by Newt Gingrich in 1994, the Democratic Party has controlled the House of Representatives all but 4 of the previous 72 years.

How should you play the legislative uncertainty?

I’m not sure the market will rally strictly on a GOP win, says Joe Terranova. Positive corporate earnings should buoy stocks, but gridlock -- I'm not so sure.

I do think a GOP win would be a huge catalyst, counters Steve Cortes. CEOs aren’t adding jobs because it costs substantially more to build plants due to litigation, taxation and regulation. I think all of that would improve under Republican control.
