The complaint alleges that during the Class Period, Delcath Systems made false and/or misleading statements and/or failed to disclose that: (a) the Company's Melblez Kit for the treatment of patients with unresectable ocular melanoma metastatic to the liver included the risk of severe toxicity and death as a result of patient's adverse reactions to the drug; and (b) the Company's manufacturing facilities were in violation of Current Good Manufacturing Practices.
On April 30, 2013, the FDA published documents revealing that 7% of the 122 patients treated with the Melblez Kit had died as a result of the treatment. On this news, shares of Delcath fell more than 40 percent. Then, on May 2, 2013, the Company announced that the ODAC voted unanimously that the benefits of the Kit did not outweigh the risks associated with the procedure. Upon this news, shares of Delcath System's fell further, to close at $0.46 per share the following day.
