Shots fired near Penn Station; suspect in critical condition

One person was shot at the intersection of 37th Street and 8th Ave., near New York City's Penn Station, after trying to attack two officers with a hammer, WNBC reported.

Initial reports said the suspect, identified as David Baril, was shot and killed at the scene. NYPD later confirmed he is in fact in "critical but stable condition" at Bellevue Hospital Center.

NYPD said that the first call about the incident came in at approximately 10:05 a.m. ET.

The hammer was recovered at the scene according . Police also said the man was struck more than once, according to The Associated Press.

Authorities said it's possible the man was the same person who attacked at least two people with a hammer this week, AP said.
