The Supreme Court said Monday it will decide whether the death penalty can be reinstated for Dzhokhar Tsarnaev, who was convicted of plotting along with his older brother the 2013 bombing at the finish line of the Boston Marathon, killing three and wounding hundreds.

The court agreed to hear an appeal filed by the Department of Justice regarding a lower court's decision which voided Tsarnaev's death sentence. The 1st U.S. Circuit Court of Appeals said the federal trial judge, George O'Toole, did not adequately ensure that jurors were unbiased in the high-profile case.
